  Medical Malpractice

Medical malpractice occurs when a person suffers severe injuries as a result of a professional's misconduct, failure to use adequate care, or lack of skill. When doctors, nurses, or other health care providers fail to perform within the required "standard of care," these health care providers, and the hospitals which employ them, can be held legally liable and required to pay appropriate compensation for any death or injury suffered by patients and their families. However, a professional will not be liable for malpractice merely because the operation or procedure was not successful.

Persons injured by medical malpractice may be entitled to recover monies for their pain and suffering, lost wages, past medical expense and future medical expenses.

According to a 1999 report issued by the National Academy of Science's Institute of Medicine, medical errors are one of the nation's leading causes of death and injury. In hospitals alone, the report explained that medical errors kill up to 98,000 people per year, which accounts for more deaths than highway accidents, breast cancer or AIDS. The Academy also concluded that more than 7,000 Americans die each year due to "medication errors," which include prescribing or dispensing the wrong drugs.

If you believe that you are a victim of medical malpractice, it is very important that you immediately contact an attorney. Every state has statutes of limitations that determine the deadline by which a person may file a medical malpractice lawsuit. Florida's statute of limitations can be as limited as two years from when the patient (or a family member or guardian) either knows, or should know with the exercise of reasonable diligence, that the injury occurred and there is a reasonable possibility that the injury was caused by medical malpractice. Because medical malpractice cases require significant investigation before filing a lawsuit, including consultations with experts and the review of medical records, it is vital that you contact an attorney well in advance of statute of limitations deadline.

If you believe that you may be the victim of medical malpractice, please contact us. Our consultation is FREE.
